Thank you for the details. I was all set to be outraged about this, but with the injuries to the deceased all being in his back, this does not seem to be a case of self defense.
The 8 year sentance may seem a little steep, but I suspect that even in Texas, which has a pretty liberal interpretation of self-defense and when you can use lethal force, the guy with the sword would probably still serve time (guessing less than five years, though).

If anyone to commit a crime breaks into anyone's house/apartment should be considered dead by stupdity if that person living there uses force to get them to leave.

I think that if the guy had quickly and efficenlty killed his assailant there in the doorway instead of just hacking and stabbing him and he eventually died in the alley then he would have gotten less of a sentence. it was the pain and suffering that the robber/victim endured. What a bleeding heart this judge must have been.
They don't mention want kind of sentence the robbers who held a gun to this guy got.
Kinda reminds me of Bernie Goetz (sp?), the New Yorker that shot and killed a kid that tried to rob him with a screwdriver. It's not that he defended himself, it's that he shot the kid a time or two, then said, "Here, have another" and shot him again.
So, remember: When faced with armed intruders, always maintain your calm to avoid future legal troubles. (Yeah, right)
