I would hardly call this court "conservative-leaning". You don't judge the leanings of a court by who appointed the justices, you gauge it by their record. So far, the count is 5-3 in appellate reviews. It just shows this matter needs to be decided by the high court. Any way you look at it, the mandate is unconstitutional. If this remains law, it will be because the high court makes yet another exception to the rule. Does affirmative action ring any bells?
They should be banished from the USA for upholding such a BS law.

There is another way of looking at this, which is maybe this court knows what it is doing and the law isn't the BS that you have been told that it is.
If I am right about this, and remember that I have sat through many legislative updates given by a very expert, and very conservative, physician who knows more about the reform than the members of Congress who voted for it do, then sooner or later you will have to face the fact that a lot of what you think you know about health care reform is either wrong or political spin.
The fact is that the reform is partly good and partly bad, but even the bad parts will be difficult to change, at least for the time being.
Consider that if the reform was the unconstitutional outrage that you have been told, things would be unfolding differently than they are. Time to face facts thebaron, you have been scammed again by political spinmeisters.
The federal government does not have the right to force you to buy a product and to consider that they should is the dumbest thing to allow a government to have the power to do.

Don't give me that the Constitution allows the Federal government has that level of control of it's people, since you better have proof. The reform is mostly bad and the few good pieces should be saved elsewhere after the law is gutted.
I am not telling you that the Constitution allows the health care reform. The Appeals Court is telling you that.
I am not trying to argue with you, thebaron, I am trying to get you to see what is happening. The guy I have been listening to giving these legislative updates isn't being fooled by anyone. He is a smart guy, with a conservative bent, that is looking out for his profession #1 and his patients #2. He is saying that the reform is probably going to pass muster, there are part of it he wishes would go away, but won't and that some of the reform is going to be good, especially for patients.
I know all of this goes contrary to the conservative media spin, but I think the conservative media spin has this all wrong and the Appeals Court has it right.

When I mentioned that it wouldn't be easy for the GOP to repeal the health care reform, I wasn't just being a partisan supporter of the reform. Today's event shows that I am correct, it will not be easy to repeal this reform. Of course anything is possible and another gigantic win next Fall for the GOP may still be able to get this done, just that it won't be easy.
The mandate is the most contentious part of the reform and at this point it looks as if it will pass constitutional muster. It isn't the wildly unconstitutional outrage that the spinmeisters made it out to be. If it was, today would have gone very differently.
