It has been illegal in Virginia for quite some time (Class 6 Felony). Cohabitation is also illegal if the unless the cohabitants are either married or platonic (Class 3 misdemeanor). Fornication is also a Class 4 misdemeanor. These laws were enacted, by the way, in an era where the Democrats controlled Virginia.
