Experimenting with specialized health courts as an alternative to jury trials in medical malpractice cases to cut down on defensive medicine.
I'm not going to get into a 5000 word essay on madville about why this is a fucking disaster, but this is horrble for patient's rights. It's going to complicate a lot of pre-existing caselaw. It's also going to make litigation a lot more expensive for quite a while. Not to mention that such a court will likely cap attorney's fees to absurdly low levels just like bankruptcy court and worker's compensation court has. Which means unless you have a truly horrific and expensive injury, you will be paying a lot of $$$ out of pocket for an attorney; that's going to prohibit a lot of people with legit injuries from filing suit. And that's not even getting into why abolishing juries for civil trials is a horrible idea on a philosophical level. What a disaster. I suspect such an abomination will never make it through the House.
I thought the only idea that the GOP had for health care is to let the insurance companies do whatever they want. Oh, and get Tort Reform, which may be a good idea but isn't going to put more than a small dent in the real problem.
